Consumer Credit Law is complex and still quite often misunderstood and the Consumer Credit Act 1974 and the regulations made under it have been subject to major change under the Consumer Credit Act 2006 and yet, further radical changes are due to take place in accordance with the requirements of the CCD.

In May 2008 the Council of the European Union approved the Directive on Consumer Credit. The Directive, a maximum harmonisation measure, will require to be implemented by all Member States by June 2010.

The Department for Business, Innovation and Skills (BIS) is leading the implementation of the Directive into UK national law and the intention for the implementation of the CCD is to make an efficient and rapid transposition by finalising the implementing legislation as soon as possible.

COURSE AIMS
The course aims to further the CCTA commitment to its members and other interested parties by keeping them well informed of the requirements of the CCD and, details of the amendments to the 1974 Act as they emerge.

COURSE CONTENT
The course will cover the history of the CCD, its purpose, its scope and a review of the key requirements, which includes, but is not limited to:
•Its application to the regulation of Consumer Credit Agreements between €200 and €75000.
•The exemptions for certain types of agreement.
•Standard advertisement provisions.
•Pre-contract information in the form of Standard European Consumer Credit Information (SECCI).
•Prescribed information to be included in Credit Agreements.
•The obligation to provide ‘adequate explanations’ and to assess a consumer’s creditworthiness.
•The borrowers right to withdraw from a Credit Agreement within 14 days without giving a reason.
•The entitlement of a borrower to the early repayment of a Credit Agreement either fully or partially.
